What is Bankruptcy?
Bankruptcy is an important legal proceeding provided for in the United States Constitution, which allows the bankrupt to reorganize and discharge debts. Bankruptcy is designed to provide relief and protection to the debtor, and to fairly distribute the debtor’s assets amongst their creditors. Bankruptcies are categorized into different chapters depending on the situation, for example:
• A Chapter 7 Bankruptcy may allow a person who cannot pay their debts, to have a fresh start and discharge their indebtedness. Bankruptcy laws have income guidelines for debtors who wish to file a Chapter 7 Bankruptcy.
• A Chapter 13 Bankruptcy may allow a person to payoff their debts, including taxes, mortgage arrearages and student loans over time. Filing a Chapter 13 frees a debtor from paying interest on unsecured debts such as credit cards or medical bills, although a reasonable rate of interest may be paid on such debts as taxes or car loans. The Chapter 13 payment is determined by income and monthly expenses. Even if a debtor’s income is too high to qualify for a Chapter 7 Bankruptcy, they may be eligible to file for a Chapter 13 Bankruptcy.
